Although we realize it is a lot of text, it is important for you to read these General Terms and Conditions of Use and Sale (the “Rules of the Game”) carefully before you proceed to make your purchase, as these Rules of the Game explain specific rules that apply to your use of our website as well as to your order.

By visiting our websites, and buying item(s) from us, you indicate that you have read and understood these Rules of the Game.

1. Who we are?

 

The terms “we”, “our” and “us” are used to refer to Foot Locker entities in Europe.

Our main establishment is Foot Locker Europe B.V. in the Netherlands. Foot Locker Europe B.V. is incorporated under Dutch law and is registered at the Dutch Chamber of Commerce under the registration number 23067735.

The identity of the seller entity of your item(s), depends on the country in which you make your purchase. Please see Annex I to these Rules of the Game, including our list of entities to find your Foot Locker entity.

2. Who can order item(s) via the website?

 

You may order our item(s) if you have reached the legal age under the laws applicable to you and are legally capable to do so.

We only sell our item(s) to end users and/or consumers who:

a.     Have a valid address in a region in which we deliver our item(s);

b.     Order the item(s) for their own personal use; and

c.     Do not resell the item(s).

We reserve the right to refuse the sale of our item(s) to resellers, retailers, or bulk buyers.

 

3. When can you order item(s) via the website?

 

Although we do our best to enable you to purchase our item(s), it may be possible that:

a.     An item shown on our website is no longer available (which could be contrary to the availability status);

b.     Additional restrictions may apply to item(s) of a “limited edition” or “limited production”, for example restrictions on the number of item(s) you may purchase; or

c.     It is not yet possible to ship our online item(s) to every country or region. Please check our website for the countries and regions where we do ship our item(s) to.

 

4. How does the order procedure work?

 

Of course, we are very pleased that you decided to order our item(s). Placing an order via our website is easy and consists of the following steps:

  1. Add the item(s) you like to order to your shopping cart;
  2. Proceed to “Order”;

(i)    If you already have a Foot Locker account, please login. If not, you can create your own account by registering on our website; or

(ii)   If you order as a guest without creating an account, please fill in all necessary information (such as your name, address, email address and telephone number);

c.     Check your information and your order before confirming;

  1. Select the preferred shipping method;
  2. Choose one of the available payment methods;
  3. Before placing an order, you will need to agree to these Rules of the Game;
  4. Proceed to place the order and pay for the item(s) (you have now entered into a binding obligation). You must complete the payment in the manner of payment chosen by you. As long as you have not completed the payment, the item(s) will not be reserved but as soon as we have received the payment confirmation, the order will be executed. This means that if you wait too long in making the payment, the risk increases that the item(s) will no longer be available;
  5. You will receive an email with all the details of your purchase. At this point a binding contract (the “Purchase Agreement”), containing these Rules of the Game, comes into existence; and
  6. As soon as we have shipped your item(s), you will receive a shipping confirmation by email.
 

5. When may we cancel your order?

 

We are entitled to refuse or cancel your order before the shipment of the item(s). However, we must have a justified reason for doing so. Examples of situations in which we can refuse or cancel an order include, but are not limited to:

  1. An obvious error or other incorrectness with regard to (an) item(s) offered by us;
  2. The item(s) is/are not available or in stock; if this is so, we will inform you as soon as possible and will not process the order;
  3. Your invoice information is not correct or is impossible to verify;
  4. We have reason to believe that your order or payment is fraudulent;
  5. There is suspicion of credit card or debit card fraud;
  6. We cannot deliver to the address stated by you;
  7. We have reason to believe that you are not an end user and/or consumer;
  8. You are under the legal age following from the laws applicable; or
  9. Payment for the purchase is not reserved or made in full.

In the above cases, we are not liable for damages or costs as a result of the refusal or cancellation of your order.

 

6. What prices does Foot Locker use?

 

The prices on our website are consumer prices and include VAT but exclude shipping costs.

The prices only apply to purchases via our website and may differ from the prices that are used for the same item(s) in a Foot Locker store. The prices may change from time to time and differ between countries, but changes will not affect any order which we have accepted. The final price to be paid will be displayed on the checkout page.

Not all item(s) and offers that are offered on our website are also available in Foot Locker stores and vice versa.

Promotions or discounts on our website cannot be used in combination with other promotions, offers or discounts. Promotions, offers and discounts only apply to purchases made via www.footlocker.eu, and may differ from the promotions, offers and discounts that may be applicable for the same item(s) in a Foot Locker store.

The costs and the expected delivery date of your item(s) will be clearly mentioned on the check-out page for your order.

 

7. How do you pay for your item(s)?

 

In principle, we will only process and deliver your order after receipt of the payment.

Foot Locker accepts various payment methods including credit and debit cards. Additionally, we offer the most commonly used payment methods in a particular country; these are visible at the bottom of our website’s homepage and are listed in our Help Center.

We do not accept other payment methods than those mentioned on our website.

We remain the owner of the item(s), until you have paid for the item(s) in full.

 

8. What delivery options do you have?

 

You can choose one of the following three delivery options that we offer:

a.     Standard shipping: the delivery timeframe and the costs vary according to each country. Depending on your country, we offer you free shipping if you order for a total amount superior to a certain threshold (which differs per country). This threshold is visible on the checkout page. If you are signed in as a FLX member (our loyalty program), you are eligible for free shipping (regardless the threshold).

b.     Express shipping: the delivery timeframe and the costs vary according to each country. Depending on your country and order, you may request express shipping. In this case, your order is usually delivered within 1-2 business days. If you are signed in as a FLX member (our loyalty program), you may obtain a reduction on the express shipping fees.

c.     Click and Collect: depending on your country of delivery, you have the option to place your order online and request to collect the package in a Foot Locker store. For more information on Click and Collect, please visit our website.

The times of delivery mentioned by us are only indications and are not guaranteed. The latest time of delivery is 30 days. We try to inform you about any delays, in so far as possible. In so far as permitted by law, we are not liable for any damages as a result of late delivery.

 

9. How will your item(s) be delivered?

 

If you choose standard shipping or express shipping, we deliver your order at the address that has been given by you when placing your order. Where we are unable to deliver to your address, we may:

  1. Divert and deliver to your neighbor;
  2. Make another delivery attempt at a later date; or
  3. Deliver your parcel at a local pick up point.

It is important that you check the parcel at the time of receipt. Even though you have 28 days to cancel your purchase without reason, where the parcel is damaged or in any way not as you would expect it, you would need to inform our Customer Service team of this defect as soon as possible, ultimately within two months counting from the delivery date. Please see chapter 14 for more information on how to handle in case of defective (an) item(s), and the consequences of refusing to report defects to our Customer Service team.

 

10. What can you do if you did not receive your order?

 

Consult your tracking information for the most accurate information on the delivery of your item(s). You may contact our Customer Service team to request an investigation into the delivery of your parcel, provided that you contact them within the following timeframe:

a.     If the tracking information states that your order has been delivered, you have 30 days counting from the delivery date stated in the tracking information to contact our Customer Service team.

b.     If the tracking information states that your order is not delivered yet, you have 100 days counting from shipping date of the order to contact our Customer Service team.

If you do not contact us within the applicable timeframe stated above, your investigation request will be automatically rejected.

11. You want to cancel your order; what should you do?

 

Although we would regret this very much, you are entitled to cancel any order and without giving a reason, except for item(s) adjusted to your personal specifications, that are clearly personalized, and item(s) which are not suitable for return due to health protection or hygiene reasons. 

Our return policy

Contact as soon as possible our Customer Service team to cancel your order. 

If the item(s) have already been shipped or have been delivered to you, you have 28 days counting from the delivery date to return the item(s) to us. You may return the item(s) to:

a. A Foot Locker store of your choice in a country where we have a European Foot Locker website.

If the Foot Locker store of your choice in the European region applies a different currency than the currency in which you purchased your item(s) online, the currency of the Foot Locker store of your choice where you return your item(s) applies.

As an exception, if you used Clear Pay as your payment method for your online purchase, it is not possible to return your item(s) in one of our Foot Locker stores. In this case, you should return your item(s) to our warehouse. 

b. Our warehouse.

If you return your item(s) to our warehouse, make sure that you fill in the Return Form which was provided with your order and put it into the box. Put the return label in the clear pouch provided and stick it on the box; if you don’t have the return label, please contact our Customer Service team. Drop your package at the access point of the relevant delivery service within 28 days counting from the delivery date.

In addition to the return policy above, you may use the model form for cancellation included in Annex II to these Rules of the Game.

Note that our return methods may differ per country. Therefore, please consult our Returns page on our website for more information on the specific return methods for your country. 

Returned item(s) must be returned in the state in which you received them. This means that the item(s) and packaging are in the original unused condition and are complete. You may only unpack the item(s) in so far as this is necessary to be able to assess the size, nature, and other characteristics of the item(s). You may, for instance, try on clothing or shoes for size but you may not wear them. Do not remove tags or labels when trying on the item(s).

The state of the returned item(s) is checked by us on receipt. If the item(s) is/are worn or damaged, we reserve the right to come back to you as to the re-sell value of the item(s).

 

12. When will Foot Locker not accept returned item(s)?

 

We do not accept returned item(s) if the item(s) are: 

a. Returned later than 28 days counting from the delivery date. The delivery date is the date the item(s) are delivered at the shipping address you chose, including if the shipping address is a pick-up point;

b. Purchased elsewhere than through our website or our Foot Locker stores;

c. Missing tags or labels; and/or

d. Damaged by misuse, negligence or unintended activity.

 

13. How and when will you receive a refund after you cancelled/returned an order/item?

 

In principle, we will refund your purchase amount via the same payment method you used to pay your online purchase.

We apply the following refund policy: 

a. When you returned the item(s) to a Foot Locker store of your choice

After we have checked the returned item(s) and concluded that the item(s) is/are in original unused condition and are complete, we will provide you with the refund via the same payment method you used to pay your online purchase.

b. When you returned the item(s) to our warehouse

After we have received the item(s) at out warehouse, checked the returned item(s) and concluded that the item(s) is/are in original unused condition and are complete, we will provide you with the refund within 14 days counting from the moment the courier accepted your return parcel. We have the right to withhold the refund until we have received the item(s) back, or until you have provided evidence of having sent back the item(s), whichever is the earliest. We will provide you with the refund via the same payment method you used to pay your online purchase.

When returning all items purchased, you will receive the full purchase amount plus the standard shipping costs (if applicable). If you have chosen for express shipping, we will not refund the express shipping costs above the amount of the standard shipping costs. 

When returning only part of an order, you will receive a refund of the value of the item(s) without the shipping costs.

14. What is your legal warranty and what can you expect if the item(s) is/are defective?

 

Under the legal warranty you may expect (an) item(s) to:

a. Be free of defects at the time of delivery;

b. Comply with what has been agreed upon, what is stated in our offer; and

c. Possess the properties that are necessary for normal use of the item.

If your item(s) is/are defective:

a. At the time of the delivery, please inform our Customer Service team of this defect as soon as possible, ultimately within two months counting from the delivery date.

b. After the time of the delivery, please inform our Customer Service team of this defect as soon as possible, ultimately within two months counting from the discovery date.

To give us a better chance to solve possible problems we ask you:

a. To state clearly to us what the defect or problem with the item(s) is; and

b. To include several pictures of the item(s) clearly showing the defect and overall state of the item(s).

We will review you claim, where necessary, request you to return the relevant item(s) to our warehouse for inspection, and contact you regarding the next steps. In the case of a well-founded claim under the warranty, we will refund the purchase price. If a delivered order is returned in full, we also refund the standard shipping costs paid by you.

If the well-found claim concerns a manufacturing defect, the warranty as prescribed by the law of the country where you live applies. These Rules of the Game do not affect your legal warranty rights. If one of the provisions in these Rules of the Game differs from the warranty rights to your disadvantage, the relevant rule does not apply, but the law in the country where you reside applies instead.

If you have not reported any defects to our Customer Service team within two months counting from the delivery date or the discovery of a defect as the case may be, this means that you have accepted the parcel, and thus, any loss, damage, or reduction in value of the item(s) is at your expense and risk. This means that if the item(s) is/are lost or damaged after you have accepted it, you are responsible for that loss or damage and you will therefore have no right to a refund of your money from us.

 

15. How do you contact Foot Locker?

 

We aim to deliver excellent service, both online and offline. Integrity, excellence, service, teamwork and community form part of our core values. If your experience with us is not of the quality we aim for, please let us know. Tell your story and do not forget to mention which store or Customer Service agent you had your experience with.

You may contact our Customer Service team via the contact form on our website, sending an email, chatting with our chat bot or our live chat with a Customer Service agent. If you use our chat bot and live chat, you can request us, via the “Email transcript” button in the chat, to send the chat transcript to your email. If you end the chat by the “End chat” button, the chat transcript is sent to your email automatically. If you close the chat without using the “End chat” button, you will not receive the chat transcript.

16. How does Foot Locker process your personal data?

17. What are the rules concerning intellectual property rights?

 

All brand names, logos, product names, service and corporate names, texts, images, illustrations, designs on our website and communications contain intellectual property rights of Foot Locker or third parties. For example, the suppliers of the item(s), photographers, and copywriters. You are not allowed to use or reproduce any expression governed by intellectual property rights as this may constitute an infringement of the holder’s rights. 

The rights in the website design, texts, documents, movies, music and/or other services and the selection and arrangement thereof, and all software compilations, underlying source codes, software and all other material on this website are owned by or licensed to Foot Locker and/or its suppliers and subcontractors. 

You are only allowed to electronically copy and to print in hard copy portions of the website to the extent this is necessary for the purpose of placing an order with us, or for using the website as a shopping resource. You are not allowed to make any other use of the information and materials on this website, including reproduction for purposes other than the one mentioned above, modification, distribution, or republication. Should you wish to use materials or information from this Website, you need our prior written approval to do so. 

To the maximum extent permitted under applicable law, you hereby indemnify and hold us harmless from and against all actions, claims and liabilities, suffered, incurred, or sustained by us as a result of your use and/or exploitation of the expressions infringing the (intellectual property) rights of any third party or otherwise being unlawful towards a third party.

 

18. How far does Foot Locker’s liability go?

 

For our item(s):

In the unlikely case that we do not fulfil our obligations with you correctly, we are responsible solely for the direct damage resulting from it up to the maximum amount that you paid for the item(s) concerned. We are not liable for any indirect damages you may suffer. This is without prejudice to any rights applicable to you under mandatory laws that cannot be deviated from. Foot Locker does not exclude or limit, or intend to exclude or limit any liability that cannot be excluded or limited under the applicable laws. 

Foot Locker is responsible for the damage resulting from the inadequate performance in the case of:

a. Death or physical injury;

b. Intent or willful recklessness of Foot Locker itself and/or its management; and

c. Any other damage for which the liability cannot be statutorily excluded or limited.

It may always happen that we are unable to meet our obligations because something happens beyond our control. We call this “force majeure”. The term force majeure includes, but is not limited to unforeseen events, wars, fires, explosions, accidents, floods, (IT) sabotage, (labour) strikes, lockouts, compliance with laws, rules, regulations or resolutions, or total failure of machinery, apparatus or processes or any other cause whether or not stated above which make our performance of the Purchase Agreement reasonably impossible or unreasonably onerous for Foot Locker. 

In case of a force majeure, we are entitled to suspend performance or terminate the Purchase Agreement.  

Foot Locker is not liable for any (delay) costs, losses, expenses, damages in any way incurred by you due to an event of force majeure, unless Foot Locker has culpably caused the relevant event of force majeure. 

For the use of our website:

Our website may provide links to external Internet sites. We are not responsible for your use or the content of websites that may be visited through links on our website. The use of links and visiting other websites occur entirely at your own risk. Other websites may contain links or frames to our website. We are not liable for any damage resulting from such a link or frame.

Although we take reasonable precautionary measures to keep our website free from viruses, we do not accept any liability for damage resulting from a virus on or passed on through our website.

 

19. Which laws and jurisdiction are/is applicable to your Purchase Agreement?

 

These Rules of the Game are applicable unless mandatory statutory provisions oppose this. If any part of these Rules of the Game must be considered not valid for any reason whatsoever, this does not affect the validity of the remaining part of the Rules of the Game and this remaining part is considered to remain in full force and effect.

The Purchase Agreement, containing these Rules of the Game, entered into between Foot Locker and you and the use of the website shall be governed by the laws of the Netherlands, without prejudice to any rights you have under applicable mandatory laws.

Any disputes arising out of or relating to the Purchase Agreement, these Rules of the Game, and/or the use of the website shall be brought exclusively before the competent court located in Amsterdam, unless within one month from being informed by Foot Locker you choose for dispute resolution by the court that would be competent in accordance with the applicable law. 

The foregoing does not affect your statutory rights.

 

20. What other rules apply?

 

We reserve the right to change these Rules of the Game at any time without prior notification, whereby the new amended Rules of the Game take effect at the time of placement on the website. You are advised to regularly check whether they have changed. Existing Purchase Agreements will not be affected by such changes. 

These Rules of the Game and conditions were last modified in February 2023.

Os termos "nós", "nosso" e "nos" são utilizados para nos referirmos às entidades da Foot Locker na Europa.

O nosso estabelecimento principal é a Foot Locker Europe B.V., nos Países Baixos. A Foot Locker Europe B.V. está constituída ao abrigo da lei holandesa e está registada na Câmara de Comércio Holandesa sob o número de registo 23067735.

A identidade da entidade vendedora do(s) seu(s) artigo(s) depende do país em que fizer a sua compra. Consulte o Anexo I destas Regras do Jogo, incluindo a nossa lista de entidades para encontrar a sua entidade Foot Locker.

2. Quem pode encomendar artigos através do site?

 

Pode encomendar o(s) nosso(s) artigo(s) se tiver atingido a idade legal nos termos da legislação que lhe é aplicável e estiver legalmente habilitado a fazê-lo.

Apenas vendemos o(s) nosso(s) artigo(s) a utilizadores finais e/ou consumidores que:

a.  Tenham um endereço válido numa região em que entregamos o(s) nosso(s) artigo(s);

b.  Encomendem o(s) artigo(s) para seu uso pessoal; e

c.  Não revendam o(s) artigo(s).

Reservamo-nos o direito de recusar a venda dos nossos artigos a revendedores, retalhistas ou compradores a granel.

 

3. Quando pode encomendar artigos através do site?

 

Embora façamos o nosso melhor para lhe permitir comprar o(s) nosso(s) artigo(s), pode ser possível que:

a.  Um artigo apresentado no nosso site já não se encontre disponível (o que pode ser contrário ao estado de disponibilidade);

b.  Podem aplicar-se restrições adicionais a artigos de uma "edição limitada" ou "produção limitada", por exemplo, restrições sobre o número de artigos que pode comprar; ou

c.  Ainda não seja possível enviar os nossos artigos online para todos os países ou regiões. Consulte o nosso site para conhecer os países e regiões para onde enviamos o(s) nosso(s) artigo(s).

 

4. Como funciona o processo de encomenda?

 

É claro que estamos muito satisfeitos por ter decidido encomendar o(s) nosso(s) artigo(s). A realização de uma encomenda através do nosso site é fácil e consiste nos seguintes passos:

1. Adicione o(s) artigo(s) que gostaria de encomendar ao seu carrinho de compras;

2. Avance para "Encomendar";

(i)  Se já tiver uma conta Foot Locker, faça o login. Caso contrário, pode criar a sua própria conta registando-se no nosso site; ou

(ii)  Se encomendar como convidado sem criar uma conta, preencha todas as informações necessárias (como o seu nome, morada, endereço de e-mail e número de telefone);

3.Verifique os seus dados e a sua encomenda antes de confirmar;

4. Selecione o método de envio preferido;

5. Escolha um dos métodos de pagamento disponíveis;

6. Antes de efetuar uma encomenda, terá de aceitar estas Regras do Jogo;

7. Prossiga para efetuar a encomenda e pagar o(s) artigo(s). Tem de concluir o pagamento da forma que for escolhida por si. Enquanto o pagamento não tiver sido concluído, o(s) artigo(s) não será(ão) reservado(s), mas assim que tivermos recebido a confirmação de pagamento, a encomenda será executada. Isto significa que se esperar demasiado tempo para efetuar o pagamento, aumenta o risco de o(s) artigo(s) deixar(em) de estar disponível(eis);

8. Irá receber um e-mail com todos os detalhes da sua compra. Neste momento, entra em vigor um contrato vinculativo (o "Contrato de Compra"), que contém estas Regras do Jogo; e

9. Logo que tenhamos enviado o(s) seu(s) artigo(s), receberá uma confirmação de envio por e-mail.

 

5. Quando podemos cancelar a sua encomenda?

 

Temos o direito de recusar ou cancelar a sua encomenda antes do envio do(s) artigo(s). No entanto, temos de ter um motivo justificado para o fazer. Exemplos de situações em que podemos recusar ou cancelar uma encomenda incluem, mas não se limitam a:

1.   Um erro manifesto ou outra incorreção relativamente a (um) artigo(s) oferecido(s) por nós;

2.   O(s) artigo(s) não está(ão) disponível(eis) ou em stock; neste caso, informá-lo-emos com a maior brevidade possível e não processaremos a encomenda;

3.   A informação da sua fatura não está correta ou é impossível de verificar;

4.   Temos motivos para acreditar que a sua encomenda ou pagamento é fraudulento;

5.   Suspeita de fraude com cartão de crédito ou cartão de débito;

6.   Não podemos entregar no endereço indicado por si;

7.   Temos motivos para acreditar que não é um utilizador final e/ou consumidor;

8.   Tem uma idade inferior à legislação aplicável; ou

9.   O pagamento da compra não está confirmado ou efetuado na totalidade.

Nos casos acima referidos, não somos responsáveis por danos ou custos como consequência da recusa ou cancelamento da sua encomenda.

 

6. Que preços pratica a Foot Locker?

 

Os preços no nosso site são preços de consumo e incluem IVA, mas não incluem custos de envio.

Os preços aplicam-se apenas a compras feitas através do nosso site e podem diferir dos preços que são utilizados para o(s) mesmo(s) artigo(s) numa loja Foot Locker. Os preços poderão mudar periodicamente e diferir entre países, mas as alterações não irão afetar qualquer encomenda que tenhamos aceite. O preço final a pagar será exibido na página de finalização da compra.

Nem todos os artigos e ofertas que são oferecidos no nosso site estão também disponíveis nas lojas da Foot Locker e vice-versa.

As promoções ou descontos no nosso site não podem ser utilizados em combinação com outras promoções, ofertas ou descontos. As promoções, ofertas e descontos aplicam-se apenas a compras efetuadas através de www.footlocker.eue  podem diferir das promoções, ofertas e descontos que podem ser aplicáveis ao(s) mesmo(s) artigo(s) numa loja Foot Locker.

Os custos e a data de entrega prevista dos seus artigos serão claramente mencionados na página de check-out da sua encomenda.

 

7. Como paga o(s) seu(s) artigo(s)?

 

Em princípio, só processaremos e entregaremos a sua encomenda depois de recebermos o pagamento.

A Foot Locker aceita vários métodos de pagamento, incluindo cartões de crédito e débito. Além disso, oferecemos os métodos de pagamento mais utilizados num determinado país; estes estão visíveis no fundo da página inicial do nosso site e estão listados no nosso Centro de Ajuda.

Não aceitamos outros métodos de pagamento para além dos mencionados no nosso site. Continuamos a ser proprietários do(s) artigo(s), até o(s) ter pago na totalidade.

 

8. Que opções de entrega têm?

 

Pode escolher uma das seguintes três opções de entrega que oferecemos:

a.  Envio normal: o prazo de entrega e os custos variam de acordo com cada país. Dependendo do seu país, oferecemos-lhe portes grátis se encomendar um montante total superior a um determinado limiar (difere por país). Este limiar está visível na página de finalização da compra. Se tiver sessão iniciada como membro FLX (o nosso programa de fidelização), é elegível para o envio gratuito (independentemente do limiar).

b.  Envio expresso: o prazo de entrega e os custos variam de acordo com cada país. Dependendo do seu país e da encomenda, pode pedir o envio expresso. Neste caso, a sua encomenda é normalmente entregue no prazo de 1-2 dias úteis. Se tiver sessão iniciada como membro FLX (o nosso programa de fidelização), pode obter uma redução das tarifas de envio expresso.

c.  Click and Collect: dependendo do seu país de entrega, tem a opção de fazer a sua encomenda online e pedir para recolher a encomenda numa loja Foot Locker. Para mais informações sobre Click and Collect, visite o nosso site.

 

9. Como será(ão) entregue(s) o(s) seu(s) artigo(s)?

 

Se optar pela entrega padrão ou pela entrega expresso, entregaremos a sua encomenda no endereço indicado por si aquando da realização da encomenda. Caso não seja possível efetuar a entrega no endereço indicado, a transportadora poderá, de acordo com os seus procedimentos de entrega:

1. Fazer um desvio e entregar ao seu vizinho;

2. Fazer outra tentativa de entrega mais tarde; ou

3. Entregar a sua encomenda num ponto de recolha local.

É importante que verifique a encomenda no momento da sua receção. Caso a encomenda apresente danos, deverá informar o nosso serviço de apoio ao cliente com a maior brevidade possível. Para mais informações sobre o procedimento a adotar em caso de artigo(s) defeituoso(s), consulte o Capítulo 14.

 

10. O que pode fazer se não tiver recebido a sua encomenda?

 

Consulte as informações de rastreamento da sua encomenda para obter as informações mais precisas sobre a entrega do(s) seu(s) artigo(s). Poderá contactar a nossa equipa de Apoio ao Cliente para solicitar uma averiguação relativa à entrega da sua encomenda. Para um tratamento eficiente de quaisquer questões relacionadas com a entrega, recomendamos que nos contacte dentro dos seguintes prazos:

a. Caso a informação de rastreamento indique que a sua encomenda foi entregue, no prazo de 14 (catorze) dias a contar da data de entrega indicada;

b. Caso a informação de rastreamento indique que a sua encomenda ainda não foi entregue, no prazo de 60 (sessenta) dias a contar da data de expedição.

 

11. Pretende devolver a sua encomenda; o que deve fazer?

 

Direito legal de livre resolução

O consumidor tem o direito legal de resolver o contrato de compra, sem necessidade de indicar qualquer motivo, no prazo de 14 dias a contar da data de entrega, com exceção dos artigos que: (i) tenham sido fabricados ou adaptados de acordo com as suas especificações pessoais; (ii) sejam manifestamente personalizados; e/ou (iii) não sejam suscetíveis de devolução por motivos de proteção da saúde ou de higiene.

Para exercer o seu direito de livre resolução, deverá informar-nos da sua decisão de resolver o contrato de compra e venda mediante uma declaração escrita inequívoca (por exemplo, através do nosso portal online de devoluções, formulário de contacto, correio eletrónico ou correio postal). Embora não seja obrigatório, poderá utilizar o modelo de formulário de livre resolução constante do Anexo II das presentes Regras do Jogo.

Deverá expedir o(s) artigo(s) para devolução no prazo de 14 dias após nos ter comunicado a sua decisão de exercer o direito de livre resolução. Consulte a nossa Política de Devoluções nas alíneas a. e b. abaixo para obter informações sobre as modalidades de devolução aplicáveis ao exercício do direito de livre resolução.

A Nossa Política de Devoluções

Sem prejuízo do seu direito legal de livre resolução, oferecemos igualmente um prazo contratual alargado de devolução de 28 dias a contar da data de entrega. Para assegurar um processo de devolução simples e eficiente, recomendamos vivamente que siga a nossa Política de Devoluções abaixo.

Caso o(s) artigo(s) já tenha(m) sido expedido(s) ou entregue(s), dispõe de um prazo de 28 dias, a contar da data de entrega, para nos devolver o(s) artigo(s). A data de entrega corresponde à data em que a encomenda é entregue no endereço de entrega indicado, incluindo quaisquer pontos de recolha por si selecionados (quando disponíveis). Caso a encomenda seja entregue num ponto de recolha local nos termos da Secção 9.3 das presentes Regras do Jogo, a data de entrega corresponde ao dia em que levantar a encomenda. Poderá devolver o(s) artigo(s)

a. Numa loja Foot Locker à sua escolha situada num país onde exista um website europeu da Foot Locker.

Para devolver uma compra realizada online numa loja, deverá apresentar o comprovativo de compra e o artigo que pretende devolver. Caso a loja Foot Locker da sua escolha na região europeia utilize uma moeda diferente daquela em que adquiriu o(s) artigo(s) online, aplicar-se-á a moeda utilizada pela loja Foot Locker onde efetuar a devolução do(s) artigo(s).

b.     O nosso armazém.

Caso devolva o(s) seu(s) artigo(s) ao nosso armazém, poderá obter uma etiqueta de devolução através do nosso portal online de devoluções ou contactando a nossa equipa de Apoio ao Cliente. Deverá afixar a etiqueta de devolução na embalagem e entregar a encomenda num ponto de entrega da transportadora relevante no prazo de 28 dias a contar da data de entrega.

Tenha em atenção que os nossos métodos de devolução podem variar consoante o país. Por isso, consulte a nossa página de Devoluções no nosso site para obter mais informações sobre os métodos de devolução específicos para o seu país.

Os artigos devolvidos devem ser devolvidos no estado em que foram recebidos. Isto significa que os artigos e respetivas embalagens devem encontrar-se na sua condição original, sem sinais de utilização, e completos. Os artigos apenas poderão ser desembalados na medida do necessário para avaliar o seu tamanho, natureza e demais características. Por exemplo, poderá experimentar vestuário ou calçado para verificar o tamanho adequado, mas não poderá utilizá-los. Não remova quaisquer etiquetas ou rótulos ao experimentar os artigos.

O estado dos artigos devolvidos será verificado por nós após a sua receção. Caso os artigos apresentem sinais de utilização ou danos que não correspondam aos defeitos comunicados por si aquando do registo da devolução, nos termos da Secção 14 das presentes Regras do Jogo, e caso esses danos resultem de um manuseamento dos artigos que exceda o necessário para determinar a sua natureza, características, funcionamento e/ou para identificar o defeito, reservamo-nos o direito de o contactar relativamente à depreciação do valor dos artigos.

 

12. Quando é que a Foot Locker não aceitará o(s) artigo(s) devolvido(s)?

 

Não aceitamos a devolução de artigos que:

1.     Tenham sido devolvidos numa loja ou expedidos para devolução ao nosso armazém após o decurso do prazo de 28 dias a contar da data de entrega, correspondente ao termo do nosso prazo contratual alargado de devolução;

2.     Tenham sido adquiridos por outros meios que não o nosso website ou as nossas lojas Foot Locker;

3.     Não incluam as etiquetas ou rótulos originais, ou não se encontrem no estado original em que foram entregues; e/ou

4.     Tenham sido danificados em consequência de utilização indevida, negligência ou qualquer utilização não prevista após a entrega.

 

13. Como e quando receberá um reembolso depois de ter devolvido uma encomenda/artigo?

 

Em princípio, iremos reembolsar o valor da sua compra através do mesmo método de pagamento que utilizou para pagar a sua compra online. Aplicamos a seguinte política de reembolso:

a. Quando devolveu o(s) artigo(s) a uma loja Foot Locker à sua escolha

Depois de termos verificado o(s) artigo(s) devolvido(s) e concluído que o(s) artigo(s) está/estão no estado original sem uso e completo(s), far-lhe-emos o reembolso através do mesmo método de pagamento que usou para pagar a sua compra online.

b. Quando devolveu o(s) artigo(s) ao nosso armazém

Após a receção do(s) artigo(s) no nosso armazém, a verificação do estado do(s) artigo(s) devolvido(s) e a confirmação de que o(s) mesmo(s) se encontra(m) no estado original, sem sinais de utilização e completo(s), procederemos ao reembolso no prazo de 14 dias a contar da data em que recebermos o(s) artigo(s) devolvido(s) no nosso armazém ou da data em que nos apresentar prova do envio do(s) artigo(s), consoante a que ocorrer primeiro. O reembolso será efetuado através do mesmo meio de pagamento utilizado para a compra online.

Ao devolver todos os artigos comprados, receberá o montante total da compra mais os custos de envio normal (se aplicável). Se tiver escolhido o envio expresso, não reembolsaremos os custos de envio expresso acima do montante dos custos de envio normal. Ao devolver apenas parte de uma encomenda, receberá um reembolso do valor do(s) artigo(s) sem os custos de envio.

14. Qual é a sua garantia legal e o que pode esperar se o(s) artigo(s) estiver(em) defeituoso(s)?

 

Ao abrigo da garantia legal, poderá esperar o(s) artigo(s):

a.  Esteja(m) isento(s) de defeitos no momento da entrega;

b.  Cumpra(m) o que foi acordado e o que é declarado na nossa oferta; e

c.  Possua(m) as propriedades necessárias para a utilização normal do artigo.

Caso o(s) seu(s) artigo(s) apresente(m) defeitos ou danos, deverá informar a nossa equipa de Apoio ao Cliente logo que possível após ter tomado conhecimento dos mesmos.

Para nos ajudar a resolver eventuais problemas de forma mais eficiente, solicitamos que:

a. Nos descreva de forma clara os danos, defeitos ou quaisquer outros problemas apresentados pelo(s) artigo(s); e

b.  Nos forneça várias fotografias do(s) artigo(s), mostrando claramente os danos, defeitos e o estado geral do(s) mesmo(s)

Analisaremos a sua reclamação e, sempre que necessário, poderemos solicitar que devolva o(s) artigo(s) em questão ao nosso armazém para inspeção. Entraremos posteriormente em contacto consigo para o informar sobre os passos seguintes. Caso a reclamação seja considerada procedente ao abrigo da garantia, reembolsaremos o preço de compra. Se uma encomenda entregue for devolvida na sua totalidade, reembolsaremos igualmente os custos de envio padrão suportados por si.

Os seus direitos legais relativos à garantia legal de conformidade aplicam-se em conformidade com a legislação aplicável.

Todos os nomes de marcas, logotipos, nomes de produtos, nomes de empresas e de serviços, textos, imagens, ilustrações, designs no nosso website e comunicações contêm direitos de propriedade intelectual da Foot Locker ou de terceiros. Por exemplo, os fornecedores dos artigos, fotógrafos e redatores. Não está autorizado a utilizar ou reproduzir qualquer expressão regulada pelos direitos de propriedade intelectual, pois isso pode constituir uma violação dos direitos do titular.

Os direitos sobre o design do site, textos, documentos, filmes, música e/ou outros serviços e a seleção e organização dos mesmos, e todas as compilações de software, códigos fonte subjacentes, software e todos os outros materiais deste site são detidos ou licenciados à Foot Locker e/ou aos seus fornecedores e subcontratados.

Apenas está autorizado a copiar eletronicamente e imprimir em papel partes do site na medida em que tal seja necessário para efeitos de realização de uma encomenda connosco, ou para utilizar o site como recurso de compras. Não está autorizado a utilizar qualquer outra informação e materiais neste site, incluindo a reprodução para outros fins que não os mencionados acima, modificação, distribuição ou republicação. Caso pretenda utilizar materiais ou informações deste site, necessita da nossa aprovação prévia por escrito para o fazer.

18.  Até onde vai a responsabilidade da Foot Locker?

 

Pelo(s) nosso(s) artigo(s):

Somos responsáveis por danos em conformidade com a legislação aplicável (consulte a Secção 19 abaixo). As presentes Regras do Jogo não excluem nem limitam a nossa responsabilidade por danos resultantes de incumprimento ou cumprimento defeituoso das nossas obrigações nos casos de:

a. Morte ou lesão corporal;

b. Dolo ou negligência grave; e

c. Quaisquer outros danos relativamente aos quais a responsabilidade não possa ser excluída ou limitada por força da lei.

Pode sempre acontecer que não sejamos capazes de cumprir as nossas obrigações porque algo acontece fora do nosso controlo. Chamamos a isto "força maior". O termo força maior inclui, entre outros, eventos imprevistos, guerras, incêndios, explosões, acidentes, inundações, sabotagem (de TI), greves (laborais), bloqueios, pandemias, cumprimento de leis, regras, regulamentos ou resoluções, ou falha total de maquinaria, aparelhos ou processos ou qualquer outra causa, acima indicada, que tornem o nosso desempenho do Contrato de Compra razoavelmente impossível ou injustificadamente oneroso para a Foot Locker.

Em caso de força maior, temos o direito de suspender a execução ou resolver o Contrato de Compra.

A Foot Locker não será responsável por quaisquer custos (incluindo os resultantes de atrasos), perdas, despesas ou danos sofridos por si em consequência de um caso de força maior, exceto se a Foot Locker tiver culposamente dado causa ao evento de força maior em causa ou aos danos dele decorrentes.

Pela utilização do nosso site:

O nosso site pode fornecer ligações para sites externos da Internet. Não somos responsáveis pela sua utilização ou pelo conteúdo de sites que possam ser visitados através de hiperligações no nosso site. A utilização de hiperligações e visitas a outros sites ocorre sob inteira responsabilidade do utilizador. Outros sites podem conter links ou frames para o nosso site. Não somos responsáveis por quaisquer danos resultantes de tal ligação ou frame.

Apesar de tomarmos medidas preventivas razoáveis para manter o nosso site livre de vírus, não assumimos qualquer responsabilidade por danos resultantes de vírus presentes ou de passagem no nosso site.

 

19. Que leis e jurisdição são/é aplicável ao seu Contrato de Compra?

 

Estas Regras do Jogo só não serão aplicáveis se disposições legais obrigatórias se opuserem a elas. Se qualquer parte destas Regras do Jogo tiver de ser considerada inválida por qualquer razão, isso não afeta a validade da parte restante das Regras do Jogo e considera-se que essa parte restante se mantém em pleno vigor e efeito.

O Contrato de Compra e Venda, incluindo as presentes Regras do Jogo, celebrado entre a Foot Locker e o cliente, bem como a utilização do website, rege-se pela legislação de Portugal.

 

20. Que outras regras se aplicam?

 

Reservamo-nos o direito de alterar estas Regras do Jogo em qualquer momento sem aviso prévio, pelo que as novas Regras alteradas do Jogo entram em vigor no momento da sua colocação no site. É aconselhável verificar regularmente se foram alteradas.

 

21. Quais são os termos e condições aplicáveis aos nossos cartões-presente?

 

Os termos abaixo aplicam-se aos cartões-presente físicos e aos cartões-presente digitais (quando disponíveis na sua região) (em conjunto, os “Cartões-Presente”) emitidos pela Foot Locker, incluindo a Kids Foot Locker.

Os Cartões-Presente podem ser utilizados para efetuar compras em lojas Foot Locker situadas em todos os países europeus onde a Foot Locker emite cartões-presente. No caso de compras online, os Cartões-Presente apenas podem ser utilizados no país em que foram emitidos.

Ao utilizar Cartões-Presente para efetuar compras, o respetivo saldo será automaticamente deduzido. Não é necessário utilizar a totalidade do saldo numa única compra. É possível utilizar vários cartões-presente na mesma compra, até ao limite de cinco Cartões-Presente por transação.

Os Cartões-Presente não podem ser trocados por dinheiro e não serão substituídos em caso de perda ou roubo. Os Cartões-Presente não podem ser utilizados para adquirir outro cartão-presente. Os Cartões-Presente não têm prazo de validade.

Pode consultar o saldo do seu Cartão-Presente a qualquer momento numa loja Foot Locker ou através do seguinte número gratuito: 0800-863-394. Os Cartões-Presente não têm qualquer valor até serem carregados com um saldo.

The terms “we”, “our” and “us” are used to refer to Foot Locker entities in Europe.

Our main establishment is Foot Locker Europe B.V. in the Netherlands. Foot Locker Europe B.V. is incorporated under Dutch law and is registered at the Dutch Chamber of Commerce under the registration number 23067735.

The identity of the seller entity of your item(s), depends on the country in which you make your purchase. Please see Annex I to these Rules of the Game, including our list of entities to find your Foot Locker entity.

2. Who can order item(s) via the website?

 

You may order our item(s) if you have reached the legal age under the laws applicable to you and are legally capable to do so.

We only sell our item(s) to end users and/or consumers who:

a. Have a valid address in a region in which we deliver our item(s);

b. Order the item(s) for their own personal use; and

c. Do not resell the item(s).

We reserve the right to refuse the sale of our item(s) to resellers, retailers, or bulk buyers.

 

3. When can you order item(s) via the website?

 

Although we do our best to enable you to purchase our item(s), it may be possible that:

a. An item shown on our website is no longer available (which could be contrary to the availability status);

b. Additional restrictions may apply to item(s) of a “limited edition” or “limited production”, for example, restrictions on the number of item(s) you may purchase; or

c. It is not yet possible to ship our online item(s) to every country or region. Please check our website for the countries and regions where we do ship our item(s) to.

 

4. How does the order procedure work?

 

Of course, we are very pleased that you decided to order our item(s). Placing an order via our website is easy and consists of the following steps:

1.   Add the item(s) you like to order to your shopping cart;

2.   Proceed to “Order”;

(i) If you already have a Foot Locker account, please login. If not, you can create your own account by registering on our website; or

(ii) If you order as a guest without creating an account, please fill in all necessary information (such as your name, address, email address and telephone number);

3.   Check your information and your order before confirming;

4.   Select the preferred shipping method;

5.   Choose one of the available payment methods;

6.   Before placing an order, you will need to agree to these Rules of the Game;

7.   Proceed to place the order and pay for the item(s). You must complete the payment in the manner of payment chosen by you. As long as you have not completed the payment, the item(s) will not be reserved but as soon as we have received the payment confirmation, the order will be executed. This means that if you wait too long in making the payment, the risk increases that the item(s) will no longer be available;

8.   You will receive an email with all the details of your purchase. At this point a binding contract (the “Purchase Agreement”), containing these Rules of the Game, comes into existence; and

9.   As soon as we have shipped your item(s), you will receive a shipping confirmation by email.

 

5. When may we cancel your order?

 

We are entitled to refuse or cancel your order before the shipment of the item(s). However, we must have a justified reason for doing so. Examples of situations in which we can refuse or cancel an order include, but are not limited to:

1.       An obvious error or other incorrectness with regard to (an) item(s) offered by us;

2.       The item(s) is/are not available or in stock; if this is so, we will inform you as soon as possible and will not process the order;

3.       Your invoice information is not correct or is impossible to verify;

4.       We have reason to believe that your order or payment is fraudulent;

5.       There is suspicion of credit card or debit card fraud;

6.       We cannot deliver to the address stated by you;

7.       We have reason to believe that you are not an end user and/or consumer;

8.       You are under the legal age as defined by applicable law; or

9.       9. Payment for the purchase is not reserved or made in full.

In the above cases, we are not liable for damages or costs as a result of the refusal or cancellation of your order.

 

6. What prices does Foot Locker use?

 

The prices on our website are consumer prices and include VAT but exclude shipping costs.

The prices only apply to purchases via our website and may differ from the prices that are used for the same item(s) in a Foot Locker store. The prices may change from time to time and differ between countries, but changes will not affect any order which we have accepted. The final price to be paid will be displayed on the checkout page.

Not all item(s) and offers that are offered on our website are also available in Foot Locker stores and vice versa.

Promotions or discounts on our website cannot be used in combination with other promotions, offers or discounts. Promotions, offers and discounts only apply to purchases made via www.footlocker.eu, and may differ from the promotions, offers and discounts that may be applicable for the same item(s) in a Foot Locker store.

The costs and the expected delivery date of your item(s) will be clearly mentioned on the check-out page for your order.

 

7. How do you pay for your item(s)?

 

In principle, we will only process and deliver your order after receipt of the payment.

Foot Locker accepts various payment methods including credit and debit cards.

Additionally, we offer the most commonly used payment methods in a particular country; these are visible at the bottom of our website’s homepage and are listed in our Help Center.

We do not accept other payment methods than those mentioned on our website. We remain the owner of the item(s), until you have paid for the item(s) in full.

 

8. What delivery options do you have?

 

 

You can choose one of the following three delivery options that we offer:

a. Standard shipping: the delivery timeframe and the costs vary according to each country. Depending on your country, we offer you free shipping if you order for a total amount superior to a certain threshold (which differs per country). This threshold is visible on the checkout page. If you are signed in as a FLX member (our loyalty program), you are eligible for free shipping (regardless the threshold).

b. Express shipping: the delivery timeframe and the costs vary according to each country. Depending on your country and order, you may request express shipping. In this case, your order is usually delivered within 1-2 business days. If you are signed in as a FLX member (our loyalty program), you may obtain a reduction on the express shipping fees.

c. Click and Collect: depending on your country of delivery, you have the option to place your order online and request to collect the package in a Foot Locker store. For more information on Click and Collect, please visit our website.

 

9. How will your item(s) be delivered?

 

If you choose standard shipping or express shipping, we deliver your order at the address that you provided when placing your order. If delivery to the indicated address is not possible, the carrier may, in accordance with its delivery practices:

1. Divert and deliver to your neighbor;

2. Make another delivery attempt at a later date; or

3.Deliver your parcel at a local pick-up point.

It is important that you check the parcel at the time of receipt. If the parcel is damaged, please inform our customer service as soon as possible.   Please see chapter 14 for more information on how to handle in case of defective item(s).

 

10. What can you do if you did not receive your order?

 

Consult your tracking information for the most accurate information on the delivery of your item(s). You may contact our Customer Service team to request an investigation into the delivery of your parcel. For efficient handling of delivery issues, we encourage you to contact us within the following timeframes:

a. If the tracking information indicates that your order has been delivered, within 14 days of the indicated delivery date;

b. If the tracking information indicates that your order has not yet been delivered, within 60 days of the shipping date.

 

11. You want to return your order; what should you do?

 

Legal right of withdrawal

You have the legal right to withdraw from your purchase agreement without giving any reason within 14 days after the delivery date, except for item(s) (i) adjusted to your personal specifications, (ii) that are clearly personalized, and/or (iii) item(s) which are not suitable for return due to health protection or hygiene reasons.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the purchase agreement through a clear written statement (for example, via our online return portal, contact form, e-mail or regular mail). Although it is not mandatory, you are free to use the model withdrawal form included in Annex II to these Rules of the Game.

You must have dispatched the item(s) for return within 14 days after you notified us of your invocation of the right to withdrawal. Please see our Return Policy under a. and b. below for the return modalities when exercising your right to withdrawal.

Our Return Policy

Without affecting your legal right of withdrawal, we also offer a contractual extended return period of 28 days from the delivery date. For a smooth and efficient return process, we strongly recommend that you follow our Return Policy below.

If the item(s) have already been shipped or have been delivered to you, you have 28 days counting from the delivery date to return the item(s) to us. The delivery date is the date on which your package is delivered at the shipping address, including any pick-up points selected by you (if available). If the package is delivered at a local pick-up point pursuant to Section 9.3 of the Rules of the Game, the delivery date is the day on which you pick up your package.

You may return the item(s) to:

a. A Foot Locker store of your choice in a country where we have a European Foot Locker website.

If the Foot Locker store of your choice in the European region applies a different currency than the currency in which you purchased your item(s) online, the currency of the Foot Locker store of your choice where you return your item(s) applies.

b. Our warehouse.

If you return your item(s) to our warehouse, you may get a return label via our online return portal or by contacting our Customer Service team. Stick the return label on the package. Drop your package at the access point of the relevant delivery service within 28 days counting from the delivery date.

Note that our return methods may differ per country. Therefore, please consult our Returns page on our website for more information on the specific return methods for your country.

Returned item(s) must be returned in the state in which you received them. This means that the item(s) and packaging are in the original unused condition and are complete. You may only unpack the item(s) in so far as this is necessary to be able to assess the size, nature, and other characteristics of the item(s). You may, for instance, try on clothing or shoes for size but you may not wear them. Do not remove tags or labels when trying on the item(s).

The state of the returned item(s) is checked by us on receipt. If the item(s) is/are worn or damaged, and this does not align with the defects you reported when registering your return in accordance with Section 14 of the Rules of the Game, and the defect is the result from how you handled the item(s) other than to establish the functioning and/or detect the defect of the item(s), we reserve the right to come back to you as to the diminished value of the item(s).

 

12. When will Foot Locker not accept returned item(s)?

 

We do not accept returned item(s) if the item(s) are:

a.  Returned in-store or dispatched for return to our warehouse by post later than 28 days after the delivery date; the end of our contractual extended return period;

b.  Purchased elsewhere than through our website or our Foot Locker stores;

c.  Missing tags or labels or not in their original in which they were delivered; and/or

d.  Damaged by misuse, negligence or unintended activity after delivery.

 

13. How and when will you receive a refund after you return an order/item?

 

In principle, we will refund your purchase amount via the same payment method you used to pay your online purchase. We apply the following refund policy:

a. When you returned the item(s) to a Foot Locker store of your choice

After we have checked the returned item(s) and concluded that the item(s) is/are in original unused condition and are complete, we will provide you with the refund via the same payment method you used to pay your online purchase within 14 days.

b. When you returned the item(s) to our warehouse

After we have received the item(s) at our warehouse, checked the returned item(s) and concluded that the item(s) is/are in original unused condition and are complete, we will provide you with the refund within 14 days from the date we receive the item(s) back to our warehouse or the date you provide evidence of having sent back the item(s), whichever is the earliest. We will provide you with the refund via the same payment method you used to pay your online purchase.

When returning all items purchased, you will receive the full purchase amount plus the standard shipping costs (if applicable). If you have chosen for express shipping, we will not refund the express shipping costs above the amount of the standard shipping costs. When returning only part of an order, you will receive a refund of the value of the item(s) without the shipping costs.

14. What is your legal guarantee and what can you expect if the item(s) is/are defective?

 

Under the legal guarantee you may expect (an) item(s)to:

a. Be free of defects at the time of delivery;

b. Comply with what has been agreed upon, what is stated in our offer; and

c. Possess the properties that are necessary for normal use of the item.

If your item(s) is/are defective or damaged, please inform our Customer Service team as soon as possible, after you discover it.

To give us a better chance to solve possible problems we ask you:

a. To state clearly to us what the damage, defect or problem with the item(s) is; and

b. To include several pictures of the item(s) clearly showing the damage, defect and overall state of the item(s).

We will review your claim, where necessary, request you to return the relevant item(s) to our warehouse for inspection, and contact you regarding the next steps. In the case of a well-founded claim under the warranty, we will refund the purchase price. If a delivered order is returned in full, we also refund the standard shipping costs paid by you.

Your legal rights regarding the guarantee of conformity apply in accordance with the applicable law.

17. What are the rules concerning intellectual property rights?

 

All brand names, logos, product names, service and corporate names, texts, images, illustrations, designs on our website and communications contain intellectual property rights of Foot Locker or third parties. For example, the suppliers of the item(s), photographers, and copywriters. You are not allowed to use or reproduce any expression governed by intellectual property rights as this may constitute an infringement of the holder’s rights.

The rights in the website design, texts, documents, movies, music and/or other services and the selection and arrangement thereof, and all software compilations, underlying source codes, software and all other material on this website are owned by or licensed to Foot Locker and/or its suppliers and subcontractors.

You are only allowed to electronically copy and to print in hard copy portions of the website to the extent this is necessary for the purpose of placing an order with us, or for using the website as a shopping resource. You are not allowed to make any other use of the information and materials on this website, including reproduction for purposes other than the one mentioned above, modification, distribution, or republication. Should you wish to use materials or information from this Website, you need our prior written approval to do so.

To the maximum extent permitted under applicable law, you hereby indemnify and hold us harmless from and against all actions, claims and liabilities, suffered, incurred, or sustained by us as a result of your use and/or exploitation of the expressions infringing the (intellectual property) rights of any third party or otherwise being unlawful towards a third party.

 

18. How far does Foot Locker’s liability go?

 

For our item(s):

We are liable for damages in accordance with applicable law (see Section 19 below). Rules of the Game do not exclude or limit our liability for damages resulting from inadequate performance in the case of:

a. Death or physical injury;

b. Intent or gross negligence, and

c. Any other damage for which the liability cannot be statutorily excluded or limited.

It may always happen that we are unable to meet our obligations because something happens beyond our control. We call this “force majeure”. The term force majeure includes, but is not limited to unforeseen events, wars, fires, explosions, accidents, floods, (IT) sabotage, (labour) strikes, lockouts, pandemics, compliance with laws, rules, regulations or resolutions, or total failure of machinery, apparatus or processes or any other cause whether or not stated above which make our performance of the Purchase Agreement reasonably impossible or unreasonably onerous for Foot Locker.

In case of a force majeure, we are entitled to suspend performance or terminate the Purchase Agreement. 

Foot Locker is not liable for any (delay) costs, losses, expenses, damages in any way incurred by you due to an event of force majeure, unless Foot Locker has culpably caused the relevant event of force majeure or resulting damage.

Our website may provide links to external Internet sites. We are not responsible for your use or the content of websites that may be visited through links on our website. The use of links and visiting other websites occur entirely at your own risk. Other websites may contain links or frames to our website. We are not liable for any damage resulting from such a link or frame.

19. Which laws and jurisdiction are/is applicable to your Purchase Agreement?

 

These Rules of the Game are applicable unless mandatory statutory provisions oppose this. If any part of these Rules of the Game must be considered not valid for any reason whatsoever, this does not affect the validity of the remaining part of the Rules of the Game, and this remaining part is considered to remain in full force and effect.

The Purchase Agreement, containing these Rules of the Game, entered into between Foot Locker and you and the use of the website shall be governed by the laws of Portugal. 

 

20. What other rules apply?

 

We reserve the right to change these Rules of the Game at any time without prior notification, whereby the new amended Rules of the Game take effect at the time of placement on the website. You are advised to regularly check whether they have changed.

 

21. What are the terms and conditions associated with our gift card?

 

The terms below are applicable to physical gift cards and digital gift cards (only if available in your region) (together as “Gift Cards”) provided by Foot Locker, including Kids Foot Locker.

Gift Cards can be used for purchases at a Foot Locker store in all European countries where Foot Locker issues gift cards. For online transactions, Gift Cards can only be used within the country of issuance.

When using Gift Cards for purchases, automatic deductions will be made to their balance. The entire balance does not have to be spent at the time of a purchase. Multiple gift cards are combinable in one single purchase, with a limit of five Gift Cards per transaction.

Gift Cards cannot be exchanged for cash and will not be replaced if they are lost or stolen. Gift Cards may not be used to purchase another gift card. Gift Cards have no expiration date.

You can check the Gift Card’s balance at any time at a Foot Locker store or by calling the following toll-free number available 0800-863-394. Gift Cards have no value until a balance is acquired.

The minimum value is 5 €, and the maximum value is 500 €.
